Denied and Underpaid Claims
After a claim is filed and the insurance company completes its investigation, the carrier has choices to make. They can either pay the full value of the claim, make a partial payment or deny the claim. At our firm we are ready for any decision that is ultimately made by the carrier. If the claim is paid in full then our job is complete. If the carrier underpays the homeowner then it is our job to show the carrier the real value of the claim. After you hire our firm, we will immediately visit the property and determine the amount of money you need to bring your property back to your pre loss condition.
Our actions moving forward will be based on the terms of your policy. Some policies force the homeowner to accept the appraisal process. This can be useful in some circumstances but detrimental in others. If a carrier is treating your unfairly and underpaying you, it is our preference to firmly negotiate with the case manager or adjuster. If we cannot make any progress during negotiations we will often file a lawsuit in County or Circuit Court.
If a claim is denied by the carrier and we accept your case we will not wait a long time to move your case forward. Rogatinsky and Matthews is a litigation law firm. We file lawsuits in any county in the state of Florida. After we file a lawsuit we will use our best efforts to prosecute your claim until we come to a reasonable conclusion with the carrier. If we accept your claim and file suit, you will not pay us any fees unless we recover money from the carrier. In fact, if your case was denied and the court reverses the insurance company decision, our attorney fees will ultimately be paid for by the insurance company.
